Governing law

This site is governed by the law of England and Wales and any dispute or action arising out of this site shall be determined in accordance with such laws. Aromax is a UK domiciled company and the currency for all transactions is Sterling.

Intellectual property rights

Intellectual Property Rights means any patents, copyright, database rights, design rights, registered designs, trade marks or service marks, trade names or know how (whether registered or not) and all rights or forms of protection of a similar nature existing anywhere in the world. All intellectual property rights on this site are owned by, or licensed to Aromax, and may not be reproduced or copied.

Internet Email

You may contact us by Internet Email via the Aromax Contact Page. Such emails are not a 100% secure method of communication. Aromax accepts no responsibility for any loss you may suffer as a result of loss or interception. Aromax advises that you do not transmit any of your personal details by Internet email. We regret that we cannot send to you confidential information by Internet email.

Secure Operation

Certain sections of this site may request a secure transport layer (SSL) from the server to your browser. This is to ensure that data is encrypted before it is sent or received over the internet.

Payments

Site payments are authorised and transferred by third party gateways. Aromax accepts no responsibility for any loss you may suffer as a result of using or accessing third party transaction processes.

Delivery Policy

Once cleared funds reach our merchant services provider your account will be activated, this usually occurs within 3 days. If you have not received notification that we have received cleared funds then it is safer to assume we have not and to contact us immediately.

Refund Policy

Account balances are non-refundable and do not bear interest. All purchased packages must be used in the validity period from the date of the purchase and no carry forward of credit will be made.

If you believe any information on this site is inaccurate or have any suggestions on how the content of this site could be improved please contact us via the Aromax Contact Page. If you have questions on a particular product or service please use the contact details shown for that product or service. Any offline information used from this site is treated as is an uncontrolled document. We update the content on this site, including this notice from time to time. Permissions

Aromax operates under the UK ICO guidelines for best practices and it is therefore mandatory that clients accept the principles of permission based marketing. Aromax services may only be used for permission-based data, without exception. Use of a purchased list or addresses obtained without permission will result in immediate termination of your account. The exceptions to this are 'soft opt-in' (for more information go to the UK ICO website).

Non-Assignment

You may not assign any rights and/or obligations under these Terms of Service to any other party.

No Liability for Unavailability

Aromax uses services from other providers (eg. Data Centres, Merchant Services Providers) and we can only offer services that rely on such services if they continue to be available to us. Aromax accepts no liability for any loss that may arise if the goods or services advertised become unavailable.

Aromax does not warrant that the operation of software and platforms will be uninterrupted or error free and always advises businesses to have contingency plans in place for circumstances outside the control of the services of a specific service provider. PLATFORM SOFTWARE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. Aromax DOES NOT PROVIDE ANY EXPRESS WARRANTIES OR REPRESENTATIONS TO CONTINUOUS AND/OR CONTINUED AVAILABILITY.

Commencement of Terms

In order to use some of the Products and/or Services of Aromax you are obliged to make payments for those Products and/or Services. This payments are usually monthly and in advance. Indication is provided wherever Products and/or Services are chargeable and Aromax have specific contractual periods of use (eg. One Year). Where a term is specified, the period for that term is contractual and payment for the entire period is expected. Any contract with Aromax for a fixed term begins only when we have received cleared funds for that Product and/or Service.

Support

Support agreements are initiated at point of purchase. All support is ticket based and your access to your account login allows to place support queries into the queue. Our support operates as follows:

  • Level I - Initial contact and first response solutions.
  • Level II - Basic system administration tasks and co-ordinate with level I support operators to resolve issues.
  • Level III - Complex customer issues such as license management, upgrades and system changes.

Termination

If at any time you breach the terms and conditions of service, Aromax may elect to suspend, terminate and/or cancel our agreement and/or recover any damages from you arising from the event(s) giving rise to the suspension, termination or cancellation. We reserve the right to suspend service at any stage for any reason we may deem necessary to continue to provide any of our services in a way that may be hindered by your status as being our client, your financial status or the content of the messages originating from you. You are also free to terminate or cancel your contract under the terms of your specific agreement at any time, and for any reason.

You will still be under the responsibilities of your agreement for the duration that you use the service and you will cease to have access to the use of any credit that may exist in your account. For such a termination or cancellation to be effective however, you must inform us in writing and receive a confirmation.

Notices

Any notices (including Termination) to be given under these Terms and Conditions, unless otherwise specified , must be in writing in the English language and be delivered personally or by registered post to the other party. In the case of post, the notice will be deemed to have been received fourteen working days after the date of posting.

Certain hypertext links in this website may lead you to websites which are not under the control of Aromax. When you activate these, you may leave the Aromax website. These links are provided solely for your convenience and do not represent any endorsement or recommendation by Aromax. THE REGISTRATION PROCESS WILL TERMINATE AND YOU WILL NOT BE GIVEN ACCESS TO THE SERVICE.
